Who Actually Owns Your Website? A Question Worth Asking Before You Need the Answer

Many businesses discover too late that they do not control their own domain, hosting or code. A short guide to establishing genuine ownership.

Article:

It is a peculiar and fairly common situation: a business with a website it has paid for in full, yet does not actually control. The domain name is registered to an agency. The hosting account belongs to a developer who has since moved on. The source files exist only on someone else's computer. The business owns the idea of the website without owning any of the pieces that make it work.

How the gap usually opens

It happens gradually, and rarely through bad intent. An agency registers the domain on the client's behalf to save time during a busy launch, and nobody revisits the paperwork afterwards. A freelance developer sets up hosting under a personal account because it was the fastest way to get started. Years later, the original arrangement is forgotten by everyone except the invoice records, until a change of supplier or a dispute forces the question into the open.

What genuine ownership looks like

The domain name should be registered in the business's own name, with the business itself listed as the registrant and holding the login credentials. Hosting should sit under an account the business controls, even if a developer is granted access to manage it. The complete source files, along with any custom code, should be available to the business on request, not held exclusively by one supplier. None of this is unusual to ask for; it is simply often left unasked.

A short audit worth doing today

Log into the domain registrar directly and confirm who is listed as the owner. Check who holds the hosting account and who can be reached if access is lost. Ask, in writing, whether a complete copy of the website can be exported at any time. If any answer is uncertain, that uncertainty is the risk itself, quite apart from whatever it might one day cost to resolve.

Reputable providers of website development and hosting services will set these arrangements up correctly from the start and will not treat the request for clarity as an inconvenience.

A website is an asset. Like any asset, it is worth confirming, in plain terms, that it actually belongs to the business that paid for it.
